What Is Deferred Action (DACA)?
Deferred Action for Childhood Arrivals (DACA) is a U.S. immigration policy that allows certain undocumented individuals, who entered the country as children, to remain in the U.S. temporarily and receive legal work authorization.
While DACA does not provide permanent legal status, it protects against deportation and provides access to lawful employment.
DACA Eligibility Requirements
To qualify for Deferred Action, applicants must meet the following criteria set by the U.S. Department of Homeland Security:
● Age Requirement – Must have been under the age of 31 as of June 15, 2012.
● Date of Entry – Entered the United States before reaching the age of 16.
● Continuous Residence – Lived in the U.S. continuously since June 15, 2007, to the present.
● Physical Presence – Physically present in the U.S. on June 15, 2012, and at the time of filing with USCIS.
● Immigration Status – Entered without inspection before June 15, 2012, or lawful status expired as of June 15, 2012.
● Education or Military Service – Currently in school, graduated from high school, obtained a GED, or honorably discharged veteran of the U.S. Armed Forces or Coast Guard.
● Criminal Record – No felony convictions, no significant misdemeanors, and not a threat to national security or public safety.
Our DACA attorneys in San Antonio will carefully review your history to confirm your eligibility.
